BK BARBECUES TERMS AND CONDITIONS
§1 General Provisions
- BK Barbecues, available at www.bk.pl, is operated by BOGDAN KOBIELA PRZEDSIĘBIORSTWO PRODUKCYJNE, HANDLOWE I USŁUGOWE ‘BK’, with its registered office at Świątkowo 24, 77-100 Bytów, Tax Identification Number (NIP): 8421002182, National Business Register Number (REGON): 770874429.
- These Terms and Conditions set out the rules for using the Online Shop and the terms and conditions for the conclusion and performance of sales contracts between the Seller and the Customer.
- In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
§2 Definitions
- Seller – BK Barbecues.
- Shop – the online shop available at www.bk.pl.
- Customer – a natural person, legal person or organisational unit purchasing Products from the Shop.
- Products – garden barbecues and barbecue accessories offered in the Shop.
§3 Subject matter of the order
- The subject matter of the order consists of the Products selected by the Customer from the current range available in the Shop. Each Product is described in detail, and the information includes, amongst other things, the price, dimensions, materials, features and availability.
§4 Placing orders
- Orders may be placed via the form on the Shop’s website, available 24/7, as well as by email or telephone (contact details available on the website).
- To place an order, you must provide your contact details, delivery address, the selected Product and the payment method.
- An order is deemed to have been accepted once the Customer has received confirmation by email.
§5 Payments and order fulfilment
- The customer is obliged to pay for the order before it is fulfilled.
- The available payment methods are: bank transfer, instant online transfer, and cash on delivery.
- The Seller may withhold fulfilment of the order until payment has been received.
§6 Delivery
- Deliveries are carried out by courier companies, or collection in person from the company’s registered office is possible.
- Delivery costs and the estimated delivery time are specified each time an order is placed.
§7 Complaints
- In accordance with the Act of 30 May 2014 on consumer rights, a Customer who is a consumer has the right to withdraw from a distance contract without giving any reason, within 14 calendar days of receiving the ordered product.
- To exercise the right of return, you must send an unambiguous statement of withdrawal from the contract (e.g. an email, a returns form or a traditional letter) to the email address kontakt@bk.pl.
- The product to be returned must be sent to the company’s address: BK Barbecues – Świątkowo 24, 77-100 Bytów
– in an undamaged condition, showing no signs of use, in its original packaging, within 14 days of notifying us of your intention to return it. - The cost of the return postage is borne by the Customer.
- Once the product has been received and inspected, the funds will be refunded within 14 working days, using the same payment method as the original transaction.
§8 Complaints
- If the product is faulty, has been mechanically damaged during transport, or does not match the description, the Customer has the right to lodge a complaint.
- Complaints may be submitted by email to: kontakt@bk.pl
The complaint must include:- the order number,
- a description of the fault or discrepancy,
- photographs illustrating the problem,
- contact details.
- Complaints are processed within a maximum of 14 working days from receipt of the complete complaint.
- If the complaint is upheld, the product may be:
- repaired,
- replaced with a new one,
- or refunded – depending on the arrangements made with the customer.
- If it is necessary to return a product that is the subject of a complaint, the Seller shall cover the cost of the return delivery – subject to prior agreement on the method of delivery.
§9 Final provisions
- The Seller reserves the right to amend these Terms and Conditions. The new Terms and Conditions shall come into force upon publication on the Shop’s website.
- Any disputes shall be settled by the court having jurisdiction over the Seller’s registered office.
